Grassland Fire Prevention Regulations

Chapter 1 General Provisions
Article 1 These Regulations are formulated in accordance with the "Grassland Law of the People's Republic of China" in order to strengthen grassland fire prevention work, actively prevent and save grassland fires, protect grasslands, and protect people's lives and property.
Article 2 These Regulations shall apply to the prevention and suppression of grassland fires in the People's Republic of China. However, except for forest areas and urban areas.
Article 3 The grassland fire prevention work shall be based on the principle of prevention, prevention and elimination.
Article 4 The people's government at or above the county level shall strengthen the organization and leadership of the grassland fire prevention work, incorporate the necessary funds for grassland fire prevention into the budget of this level, and ensure the prevention of grassland fires and the implementation of fighting against the fire.
The grassland fire prevention work shall be carried out by the local people's governments at all levels and shall be responsible for the system of administrative chiefs and departments and units.
Article 5 The grassland administrative department of the State Council shall be responsible for the national grassland fire prevention work.
The competent department of grassland fire prevention determined by the local people's government at or above the county level shall be responsible for grassland fire prevention work within its administrative area.
Other relevant departments of the people's government at or above the county level shall do a good job of grassland fire protection within their respective duties.
Article 6 The operating units and individuals of the grasslands shall assume responsibility for grassland fire prevention within the scope of their operations and use.
Article 7 Where grassland fire prevention involves two or more administrative regions or involves forest fire prevention and urban firefighting, the relevant local people's governments and relevant departments shall establish a joint defense system, determine joint defense zones, formulate joint defense measures, and strengthen information communication and supervision and inspection.
Article 8 The people's governments at all levels or relevant departments shall strengthen the propaganda and education activities of grassland fire prevention and improve citizens' awareness of grassland fire prevention.
Article 9 The State encourages and supports scientific and technological research on grassland fire prevention and suppression, and promotes advanced grassland fire prevention and suppression techniques.
Article 10 Units and individuals that have made outstanding contributions or made outstanding achievements in the prevention and suppression of grassland fires shall be commended and rewarded in accordance with relevant state regulations.
Chapter II Prevention of Grassland Fires
Article 11: The grassland administrative department of the State Council classifies the national grassland into four levels of prairie fire danger zones of extremely high, high, medium and low levels based on the degree of danger and the scope of impact of grassland fires.
Article 12 The grassland administrative department of the State Council shall formulate a national grassland fire prevention plan based on the actual fire-danger zone division and grassland fire prevention work and submit it to the State Council or a department authorized by the State Council for approval and implementation.
The grassland fire control department of the local people's government at or above the county level shall, in accordance with the national plan for grassland fire prevention and in combination with local realities, formulate plans for grassland fire prevention in the administrative area and report it to the people's government at the same level for approval and implementation.
Article 13 The grassland fire prevention plan shall mainly include the following contents:
(1) The basis for the development of grassland fire prevention planning;
(2) Construction of a grassland fire prevention organization system;
(3) Construction of grassland fire prevention infrastructure and equipment;
(D) grassland fire protection material reserves;
(e) Safeguards.
Article 14 The people's government at or above the county level shall organize relevant departments and units to strengthen the construction of infrastructure such as grassland fire observation and monitoring facilities, fire separation belts, fire prevention roads, and fire protection material storage bases (stations) in accordance with the plan for grassland fire prevention. Grassland fire prevention transportation equipment, fire-fighting equipment, observation and communication equipment and other equipment, storage of necessary fire protection materials, establish and improve the grassland fire prevention command information system.
Article 15 The competent department of grassland administration under the State Council shall be responsible for formulating the emergency plan for grassland fires in the whole country and submit it to the State Council for approval and implementation.
The competent grassland fire control department of the local people's government at or above the county level shall be responsible for formulating emergency plans for grassland fires in its administrative area, and report to the people's government at the same level for approval and implementation.
Article 16 Emergency plans for grassland fires shall mainly include the following contents:
(1) Grassland fire emergency organizations and their duties;
(b) Grassland fire warning and prevention mechanisms;
(3) Procedures for reporting on grassland fires;
(4) emergency treatment measures for grassland fires of different grades;
(5) The emergency protection of materials, funds and teams required for fighting grassland fires;
(6) Emergency plans such as evacuation of personnel and property, medical treatment, and disease control.
Grassland fires are classified into four categories, namely, major, major, large, and general, depending on the area of ​​the affected grassland, the number of casualties, the number of affected livestock, and the threat to urban and rural residential areas, important facilities, places of interest, and nature reserves. The specific division criteria shall be formulated by the grassland administrative department of the State Council.
Article 17 The local people's government at or above the county level shall determine the period of grassland fire prevention in its own administrative region in accordance with the law of occurrence of grassland fires, and announce it to the public.
Article 18 During the period of grassland fire prevention, if it is necessary to use fire on grasslands in the course of production activities, it shall be approved by the competent department of grassland fire protection at the county level. Fire units or individuals should take fire prevention measures to prevent fire.
During the period of grassland fire prevention, if it is necessary to use fire on the grasslands for life, safe places should be selected and fire prevention measures should be taken to completely extinguish the residual fire after the fire is used.
Except for the circumstances stipulated in the first and second paragraphs of this Article, fire is prohibited in the wild on the grasslands during the period of fire protection in the grasslands.
Article 19 It is forbidden to use the hunting of firearms on grasslands during the period of grassland fire prevention.
During the period of grassland fire prevention, activities such as blasting, surveying and construction on grasslands shall be approved by the grassland fire control department of the local people's government at or above the county level and fire prevention measures shall be taken to prevent fires.
During the period of grassland fire prevention, the troops shall carry out live fire exercises on the grasslands, handle sudden events, and perform other tasks. They shall take necessary fire prevention measures.
Article 20 During the period of grassland fire prevention, motor vehicles operating or driving on grasslands shall be equipped with fire prevention devices to prevent fires caused by fire leakage, fire breezes and brake shoes falling off. Drivers and crew members on public transport traveling on the grasslands should conduct grassland fire prevention publicity for passengers. Drivers, crew members and passengers must not discard fire.
During the period of grassland fire prevention, fire protection measures shall be taken for mechanical equipment engaged in field operations on grasslands; and operating personnel shall observe the fire safety operation rules to prevent fires.
Article 21 Within the period of grassland fire prevention, with the approval of the people's government at the same level, the competent department of grassland fire prevention shall carry out grassland fire safety inspections on vehicles that have entered the grasslands, vehicles with potential fire hazards, and field operations that may trigger grassland fires. If it is found that there are hidden fire hazards, relevant responsible personnel shall be informed to take measures to eliminate potential fire hazards; if they refuse to take measures to eliminate potential fire hazards, they shall not enter the grasslands or engage in field operations on the grasslands.
Article 22 When high-temperature, drought, strong wind, and other high-fire danger weather occurs during the grassland fire prevention period, local people's governments at or above the county level shall cause extreme personal injury to the extremely high grassland fire risk areas, high grassland fire risk areas, and once grassland fires occur. The areas of casualties or heavy losses of property are classified as grassland fire prevention control zones, and the regulatory deadlines shall be announced in a timely manner to the public and reported to the people's government at the next higher level for the record.
In the grassland fire control zone, all field fires are prohibited. For non-field fires that may cause grassland fires, local people's governments at or above the county level or grassland fire control authorities shall strictly manage them in accordance with regulatory requirements.
Vehicles that enter the grassland fire control zone shall obtain a grassland fire prevention permit issued by the grassland fire control department of the local people's government at or above the county level and shall be subject to fire control.
Article 23 Agricultural (pasture) farms, industrial and mining enterprises, and other production and business units on grasslands, as well as garrison units, natural-reserve management units, and rural collective economic organizations, shall be leaders and grasslands of local people's governments at or above the county level. Under the guidance of the fire department, the responsibility system for fire prevention in the grasslands was implemented, fire source management was strengthened, fire hazards were eliminated, and the unit's grassland fire prevention work was well done.
The operating units of railways, highways, power and telecommunication lines, and oil and gas pipelines shall implement fire prevention measures in their grassland fire protection responsibility areas to prevent the occurrence of grassland fires.
Individuals contracting for grassland management shall strengthen fire source management, eliminate hidden fire hazards, and perform grassland fire prevention obligations.
Article 24 The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may designate key grassland fire protection areas in accordance with the actual situation in the area and report them to the competent grassland administrative department of the State Council for the record.
The local people's governments at or above the county level in the key grassland fire prevention areas and the management units for nature reserves shall establish professional fire fighting teams as required; related townships (towns) and villages shall establish mass fire fighting teams. Fire fighting teams should conduct professional training and accept the command and transfer of local people's governments at or above the county level.
Article 25 The competent departments of grassland fire prevention and the competent meteorological departments of the people's governments at or above the county level shall jointly establish a forecast and early warning system for the fire danger of grasslands. The competent meteorological agency shall do a good job in forecasting and releasing the meteorological grades of grassland fire hazards according to the actual needs of the grassland fire prevention; the news media shall timely broadcast the meteorological grade forecast of the grassland fire danger.
Chapter 3 Extinguishing Grassland Fires
Article 26 Units and individuals engaged in monitoring of grassland fires and engaged in production and business activities on grasslands shall, if they discover the grassland fire, take necessary measures and report to the local people's government or grassland fire control department in a timely manner. Other units and individuals that have discovered grassland fires should also report to local people’s governments or grassland fire prevention authorities in a timely manner.
After receiving the report, the local people's government or the grassland fire control department shall immediately organize the personnel to rush to the scene to verify the fire, take control and save measures, and prevent the expansion of the grassland fire.
Article 27 The local people's government or the grassland fire control department shall promptly report the time and place of the grassland fire, the estimated burned area, and the development trend of the fire to the higher people's government and its grassland fire control department; the grassland fire outside the territory threatens The safety of grasslands in China should also report the distances from the borders of China's grassland fires to the country's borders, the degree of extension along the borders, and the threat to the grasslands in China.
It is forbidden to report, misrepresent, or inform others about false reports of grassland fires.
Article 28 The local people's government at or above the county level shall determine the fire rating based on the occurrence of grassland fires and initiate the emergency plan for grassland fires in a timely manner. Where grassland fires that are particularly significant, major grassland fires, and grassland outside the territory threaten the security of grasslands in China, the grassland administrative department of the State Council shall promptly initiate emergency plans for grassland fires.
Article 29 After the emergency plan for grassland fires is started, the local people's government concerned shall immediately organize and direct the extinguishing work of grassland fires in accordance with the requirements of the emergency plan for grassland fires.
In combating grassland fires, people's lives should be protected first. The local people's governments concerned should promptly mobilize residents and other people threatened by grassland fires to move to safe areas and properly place them; in case of emergency, they can forcibly organize disaster avoidance and evacuation.
Article 30 Relevant departments of the people's government at or above the county level shall, in accordance with the division of labor for the emergency plan for grassland fires, do a good job of the corresponding grassland fire emergency work.
The competent meteorological agency shall do a good job in meteorological monitoring and forecasting, provide weather information to the local people's government in time, and implement artificial rainfall in accordance with weather conditions.
The civil affairs department shall promptly set up places for evacuation and supply points of relief materials and carry out rescue work for the affected people.
The competent health department shall do a good job in medical rescue, sanitation and epidemic prevention.
Railways, transportation, aviation, and other departments should give priority to transporting relief supplies, equipment, drugs, and food.
The competent department of communications shall organize the provision of emergency communications guarantees.
The public security department shall promptly investigate and deal with grassland fire cases and do a good job in the maintenance of public order.
Article 31 The fire-fighting of grassland fires shall organize and mobilize professional fire-fighting teams and fire-fighting teams that have received professional training. Units and individuals who have received orders for fighting against them must rush to the designated place and be put on fire-fighting work.
To save grassland fires, mobilization of disabled persons, pregnant women, minors, and senior citizens may not be mobilized.
If the Chinese People's Liberation Army and the Chinese People's Armed Police Force are required to participate in the fight against grassland fires, they shall be implemented in accordance with the relevant provisions of the "Regulations on the Participation of the Army in Rescue and Relief."
Article 32 According to the needs of fighting grassland fires, the local people's government concerned may urgently expropriate materials, means of transport, and related facilities and equipment; if necessary, it may take steps to remove obstacles, build barriers, take emergency water, and control local traffic. Emergency management measures.
As for the need for disaster relief, the emergency expropriation of materials, vehicles, facilities, and equipment of units and individuals or occupation of their houses and land shall be promptly returned afterwards and compensation shall be provided in accordance with relevant laws and regulations.
Article 33 In the case of a particularly serious grassland fire, the grassland administrative department of the State Council shall immediately send personnel to the scene of the fire, organize, coordinate, supervise and fight the fire, and do a good job of transferring grassland fire prevention materials across provinces, autonomous regions and municipalities directly under the central government. .
In the case of grassland fires that threaten the safety of forest areas, the relevant grassland fire prevention authorities shall promptly notify the relevant forestry authorities.
If grassland fires outside the territory threaten the security of grasslands in China, the grassland administrative department of the State Council shall immediately send personnel to the relevant sites to organize, coordinate and supervise fire prevention and notify the Ministry of Foreign Affairs in a timely manner.
Article 34 The State implements the unified publication system for grassland fire information. Information on grassland fires that are particularly significant, significant grassland fires, and threatening the safety of grasslands in China shall be issued by the grassland administrative department of the State Council; other information on grassland fires shall be issued by the competent grassland fire control department of the people's government of the province, autonomous region or municipality directly under the Central Government.
Article 35 The local people's government at or above the county level in key grassland fire prevention areas may, in accordance with the provisions of the emergency plan for grassland fires, set up a grassland fire prevention headquarters to exercise the duties of the people's government at the same level as this chapter in the fight against grassland fires.
Chapter IV Disposal after Disasters
Article 36 After the grassland fire has been extinguished, the competent grassland fire control department of the local people's government or its designated unit shall conduct a comprehensive inspection of the fire scene, remove the excess fire, and leave sufficient personnel to guard the fire. After inspection and acceptance by the grassland fire protection authorities, the guards may withdraw.
Article 37 After the grassland fire has been extinguished, the local people's government concerned shall organize relevant departments to do a good job in resettling and assisting the victims in a timely manner to protect the basic living conditions of the victims, do a good job of sanitation and epidemic prevention, and prevent the occurrence and spread of infectious diseases.
Article 38 After the grassland fire is extinguished, the local people's government concerned shall organize relevant departments to formulate grassland restoration plans in a timely manner, organize and implement technical measures such as reseeding grass seeds and artificial grass cultivation, restore grassland vegetation, and do a good job of livestock and poultry quarantine work. Prevent the occurrence of animal diseases.
Article 39 After the grassland fire is extinguished, the competent grassland fire control department of the local people's government shall promptly, together with the public security and other relevant departments, investigate the time, location, and causes of the fire, and the perpetrators, etc., and put forward opinions on the handling.
The grassland fire protection authority shall make statistics on the affected grassland area, types and numbers of affected livestock and poultry, types and numbers of wild and endangered animals and plants affected, casualties, material consumption, and other economic losses. The grassland fire will affect urban and rural residents' lives, industry and agriculture. The impacts of production and ecological environment will be assessed and reported in accordance with the provisions of the administrative department of grassland of the State Council.
Article 40 The competent grassland fire control department of the local people's government shall strictly perform the grassland fire statistics according to the requirements of the statistical report on grassland fires, report it to the grassroots fire control department of the people's government at the next higher level, and copy it to the public security department and statistical agency at the same level. The statistical report on grassland fires shall be formulated by the grassland administrative department of the State Council jointly with the public security department of the State Council and reported to the national statistical department for the record.
Article 41 Medical personnel or pensions shall be granted in accordance with the relevant provisions of the State for those who have been rescued, injured or maimed by participating in grassland fires.
Chapter V Legal Liability
Article 42 Those who, in violation of the provisions of these Regulations, the people's government at the county level or above in charge of grassland fire prevention departments or other relevant departments and their staff members commit one of the following acts, shall be ordered by their superior administrative organ or supervisory organ to make corrections; if the circumstances are serious, The person in charge who is directly responsible and other directly responsible personnel shall be given a punishment according to law; if a crime is constituted, criminal responsibility shall be investigated according to law:
(1) failing to formulate an emergency plan for grassland fires in accordance with the provisions;
(2) Approving field fires or blasting, surveying and construction activities that do not meet the requirements for grassland fire protection;
(3) distributing grassland fire prevention permits to vehicles that do not meet the requirements;
(4) to report, misrepresent or inform others about false reports of grassland fires;
(5) failing to take timely measures to fight against grassland fires;
(6) Other acts that do not perform their duties according to law.
Article 43 If a person withholds or misappropriates grassland fire prevention funds or misappropriates or misappropriates grassland fire prevention materials, it shall be dealt with in accordance with the laws and regulations concerning the penalties for punishment for financial violations; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 44 Whoever commits one of the following acts in violation of the provisions of these Regulations shall be ordered by the grassland fire control department of the local people's government at or above the county level to stop the illegal act, take fire prevention measures, and renew the relevant formalities within a time limit. The person responsible shall be placed at 2,000 yuan. The above fine of less than 5,000 yuan shall be imposed on the relevant responsible entity to impose a fine of 5,000 yuan up to 20,000 yuan:
(1) Fires or blasting, surveying and construction activities in the wild on grasslands without approval;
(2) Failure to obtain grassland fire prevention passes into the grassland fire control zone.
Article 45 Whoever violates the provisions of these Regulations and commits any of the following acts shall be ordered by the grassland fire control department of the local people's government at or above the county level to stop the illegal act, adopt fire prevention measures, eliminate hidden fire hazards, and place more than 200 yuan on responsible personnel. Fines of less than RMB 2,000 shall be imposed on fines of more than RMB 2,000 but less than RMB 20,000 for the responsible units. Where fire-fighting measures are not adopted to eliminate hidden fire hazards, the grassland fire control department of the local people's government at or above the county level shall adopt fire prevention measures to eliminate hidden fire hazards. The required expenses shall be borne by the illegal entity or individual:
(1) During the period of grassland fire prevention, fire protection measures have not been taken in the approved field fire;
(2) The motor vehicles operating and driving on grasslands are not equipped with fire protection devices or have hidden fire hazards;
(3) A driver, crew member or passenger on a public transport driving on a grassland discards fire;
(4) The operators of mechanical equipment engaged in field operations on grasslands do not comply with the fire safety operation regulations or fail to take fire prevention measures against the mechanical equipment in field operations;
(5) Failure to use fire in the grassland fire control zone as required.
Article 46 In case of violation of the provisions of these Regulations, the production and operation units on the grasslands have not established or failed to implement the responsibility system for grassland fire prevention, and the grassland fire prevention authorities of the local people's governments at or above the county level shall order them to make corrections. The relevant responsible units shall be over 5,000 yuan. Fines of less than 20,000 yuan.
Article 47 Whoever violates the provisions of these Regulations and intentionally or negligently causes grassland fires and constitutes a crime shall be investigated for criminal responsibility according to law.
Chapter VI Supplementary Provisions
Article 48 Grassland fire-fighting vehicles shall be painted in accordance with the regulations, and alarms and signs shall be installed.
Article 49 This Regulation shall come into force on January 1, 2009.
